Terms and Conditions
This agreement outlines the general terms and conditions (hereinafter referred to as "TERMS AND CONDITIONS") applicable to the mere use of or access to any pages, web and mobile applications, software, general applications, as well as the use of content, products, and services offered through the website https://www.innolegals.com (hereinafter collectively referred to as the "PORTAL"), owned by Innolegals and/or its subsidiaries, parent companies, related parties, and affiliates (hereinafter collectively referred to as the "OWNER").
Anyone wishing to access or use the site or the services offered therein (hereinafter referred to as the "USER") may do so subject to these TERMS AND CONDITIONS, as well as the policies and principles incorporated into this document. By accessing or using the PORTAL, it will be understood that the USER accepts and agrees to comply with these TERMS AND CONDITIONS. Any individual who does not accept these TERMS AND CONDITIONS must refrain from using the PORTAL and/or purchasing the products or services offered therein.
I. PURPOSE
The purpose of these TERMS AND CONDITIONS is to regulate the access to and use of the PORTAL, which includes any type of content, products, or services made available to the general public through the PORTAL.
The OWNER reserves the right to modify, at any time and without prior notice, the presentation, contents, products, services, functionality, and configuration contained in the PORTAL. Consequently, the USER acknowledges and accepts that the OWNER may interrupt, deactivate, or cancel any of the elements that comprise the PORTAL or access to them at any time.
Purchasing a product or service through the PORTAL does not necessarily imply the OWNER's automatic acceptance of the USER's request. All related services, particularly those connected to visa processing or other legal formalities, are subject to eligibility verification. If the USER does not meet the necessary requirements for the relevant application, their request may be automatically rejected without incurring any liability on the part of the OWNER.
Moreover, purchasing services through the PORTAL does not in any way guarantee the issuance of a visa or the success of any requested formalities. The USER acknowledges and accepts the risk that the application may be denied by the relevant authorities at the time of purchase.
In addition to the cost of the internet connection based on the services the USER has contracted with a telecommunications provider, some of the content, products, or services offered on the PORTAL or by third parties may require prior contracting. In such cases, this will be clearly specified, and the general or specific conditions governing access to such content will be made available to the USER.
II. USER
Access to or use of the PORTAL, as well as resources enabled for interaction among USERS or between the USER and the OWNER (such as means for posting or commenting), grants the status of USER of the PORTAL. This status subjects the USER to these TERMS AND CONDITIONS and any subsequent amendments, without prejudice to applicable laws. Therefore, these TERMS AND CONDITIONS shall be deemed accepted from the moment the USER accesses the PORTAL. Given the importance of this, USERS are advised to review any updates to these TERMS AND CONDITIONS regularly.
The USER must be at least 18 years old to use the PORTAL and the services it offers. By accessing the PORTAL and accepting these TERMS AND CONDITIONS, the USER represents and warrants that they are at least 18 years old.
The USER is responsible for using the PORTAL as designed. Consequently, the use of any software to automate interactions or download content or services provided through the PORTAL is prohibited. Furthermore, the USER agrees to use the information, content, products, or services offered through the PORTAL lawfully, without violating these TERMS AND CONDITIONS, public morals, or public order, and to refrain from any actions that could harm third-party rights or impair the operation of the PORTAL.
Additionally, the USER agrees to provide accurate and lawful information in the forms available on the PORTAL, where the USER is required to submit certain data or information to access some content, products, or services offered through the PORTAL. In any event, the USER shall immediately notify the OWNER of any event suggesting misuse of the information registered in such forms, such as theft, loss, or unauthorized access to accounts and/or passwords, to proceed with their immediate cancellation.
The OWNER reserves the right to remove any comments or contributions that violate the law, respect for human dignity, are discriminatory, infringe upon the rights of third parties or public order, or that, in its opinion, are not suitable for publication.
In any case, the OWNER shall not be liable for opinions expressed by the USER through comments or publications they make.
Accessing the PORTAL does not establish any kind of relationship between the OWNER and the USER.
The USER may contact the OWNER at any time for any clarification, comment, query, and/or suggestion related to the contents, products, or services of the PORTAL and/or these TERMS AND CONDITIONS through the contact information available on the PORTAL.
III. ACCESS AND NAVIGATION ON THE PORTAL
The OWNER does not in any way guarantee the continuity or availability of the content, products, or services offered through the PORTAL. However, the OWNER will undertake actions within its means to maintain the proper functioning of the PORTAL, without this implying any liability on the part of the OWNER.
Similarly, the OWNER will not be held responsible or guarantee that the content or software accessible through the PORTAL is error-free, free from malicious software, or that it will not cause any damage to the software or hardware of the device used by the USER to access the PORTAL.
The OWNER is also not responsible for damages that may result from the improper use of the PORTAL. Under no circumstances will the OWNER be liable for any losses, damages, or harm of any kind arising solely from access to or use of the PORTAL.
IV. PRIVACY POLICY AND DATA PROTECTION
In accordance with the applicable legislation, the OWNER commits to taking the necessary measures within its reach to ensure the privacy of personal data collected, guaranteeing its security and preventing its alteration, loss, or unauthorized processing.
Moreover, to comply with the applicable legislation, all personal data collected through the PORTAL will be treated in accordance with the principles of legality, quality, purpose, loyalty, and responsibility. Any processing of personal data will require the consent of the data subject. In any case, the use of financial or asset-related data will require the express authorization of their owners, which may be granted through the PORTAL using the mechanisms enabled for this purpose. The utmost diligence and care will always be applied to such data. The same applies to sensitive personal data, defined as those that, if misused, could lead to discrimination or pose a risk to the data subject.
Efforts will always be made to ensure that personal data contained in databases or files, if used, are relevant, accurate, and up-to-date for the purposes for which they were collected.
The PORTAL may include hyperlinks or links allowing access to third-party websites distinct from the OWNER. The owners of such websites will have their own privacy and data protection policies. The OWNER assumes no responsibility for the data provided by the USER through any website other than the PORTAL.
The OWNER reserves the right to modify its Privacy Policy or Notice as needed or due to changes in the legislation. Access to or use of the PORTAL following such changes implies acceptance of these modifications.
Furthermore, access to the PORTAL may involve the use of cookies, which are small amounts of information stored in the browser used by the USER. Cookies facilitate navigation, make it more user-friendly, and do not harm the browsing device. They may collect information such as login details for the PORTAL, USER preferences, and interactions with the PORTAL, including but not limited to the date and time of access, duration of use, sites visited before and after the PORTAL, number of pages viewed, the USER’s IP address, visit frequency, and more.
This information will be used to improve the PORTAL, detect errors, and address potential needs of the USER to offer higher quality content, products, or services. In any case, the information collected will remain anonymous and will not identify the USER individually.
If the USER does not wish to allow the collection of such information, they should disable, reject, restrict, and/or delete the use of cookies in their internet browser. Procedures to perform these actions may vary between browsers; therefore, it is recommended to review the instructions provided by the browser's developer. If the USER rejects the use of cookies (in whole or in part), they may still use the PORTAL, although some functionalities may be disabled.
These policies regarding cookies may be updated or modified in the future. It is advisable to review updates made to these TERMS AND CONDITIONS to stay adequately informed about how and why cookies are used when accessing or using the PORTAL.
V. LINKING POLICY
The PORTAL may contain links, features, content, or services from other websites owned and/or managed by third parties, such as, for example, but not limited to, images, videos, comments, search engines, among others.
The use of these links, features, content, or services is intended to improve the USER's experience when using the PORTAL, without implying a suggestion, recommendation, or invitation to use external sites. The OWNER will not, under any circumstances, review or control the content of external sites. Likewise, the OWNER does not adopt as its own the content, products, services, or any other material present on the linked sites; therefore, the OWNER does not guarantee the availability, accuracy, truthfulness, validity, or legality of the external sites accessible through the PORTAL. Furthermore, the OWNER will not assume any responsibility for damages that may arise from accessing or using the content, products, or services available on websites not managed by the OWNER, which may be accessed through the PORTAL.
The USER or third parties who create or publish a web link from an external website to this PORTAL must take into account the following:
- The reproduction (in whole or in part) of the content, products, or services available on the PORTAL is not allowed without the express authorization of the OWNER. False, inaccurate, or incorrect statements about the PORTAL or its content, products, or services are also not allowed. The OWNER may restrict access to the PORTAL for anyone who engages in such acts.
- The establishment of a link to the PORTAL from any external site does not imply the existence of any relationship between the OWNER and the owner of the website from which the link is made, nor does it imply the OWNER's knowledge of the content, products, or services offered on external sites from which the PORTAL can be accessed.
VI. PAYMENT AND BILLING POLICY
You must pay all fees or charges to your account in accordance with the rates, charges, and billing terms in effect at the time a charge is due and paid. If, in our judgment, your purchase constitutes a high-risk transaction, we will ask you to provide a copy of your valid government-issued photo ID and possibly a copy of a recent bank statement for the credit or debit card used for the purchase. We reserve the right to change the prices of products at any time.
We also reserve the right to reject any order you place with us. At our sole discretion, we may limit or cancel quantities purchased by person, by household, or by order. These restrictions may include orders made by or under the same customer account, the same credit card, and/or orders using the same billing and/or shipping address. If we make a change or cancel an order, we may attempt to notify you by contacting the email address and/or billing address/phone number provided at the time the order was placed.
VII. REFUND POLICY
1. The provision of services shall commence immediately upon receipt of payment or the signing of the contract, whichever occurs first. The services provided are personalized and customized, tailored to the specific circumstances and requirements of each individual applicant.
Refund Policies:
2. The refund policy for NLV (Non-Lucrative Visa) and DNV (Digital Nomad Visa) services states that, in the event of a visa rejection, a full refund may be provided, excluding any third-party-related costs. These non-refundable expenses include, but are not limited to, government fees, translations, apostilles, payment platform fees, currency exchange fees, and other additional services or charges.
3. For EV (Entrepreneur Visa) services, the refund amount varies based on the plan selected:
Basic Plan: Refund percentage is 30%.
Enhanced Plan: Refund percentage is 40%.
Elite Plan: Refund percentage is 45%.
It is important to note that under all plans, third-party fees and additional services are non-refundable under any circumstances.
4. To be eligible for the refund policies outlined above, the client must provide evidence that all required documentation was submitted accurately, completely, and without falsification. In the event that any discrepancies, inaccuracies, or irregularities are identified in the submitted documents or in the application, the refund shall be forfeited. Furthermore, if the visa application is rejected due to the client’s inability to meet the established requirements—such as failing to provide a criminal record certificate, adequate financial proof, or other documents mandated by the embassy—the refund will not be granted.
5. Refunds are determined on an individual basis for each applicant, including the main applicant and any dependent(s). In the event that a dependent’s application is rejected, this shall not entitle the main applicant or other approved dependents to a refund.
Cancellation Policies:
6. Given that what we offer is a personalized and customized service for each applicant, for cancellations within 14 days of purchase, a partial or full refund may be requested based on the proportion of services already provided. However, if the service has been fully delivered, no refund or cancellation can be granted, in accordance with Real Decreto Legislativo 1/2007.
7. Beyond 14 days from the purchase date, cancellations or refunds are not permitted.
8. Under certain circumstances, customized refund policies, as outlined in the contract, may apply to address specific situations and may differ from the general refund policy. In such instances, the customized refund policy shall take precedence.
9. For cancellation or refund requests, the main applicant should send an email to support@innolegals.com, with the subject line “Cancellation or Refund Request – [Main Applicant’s Name].”
VIII. INTELLECTUAL AND INDUSTRIAL PROPERTY POLICY
The OWNER, either personally or as an assignee, holds all intellectual and industrial property rights of the PORTAL, including the source code that makes its operation possible, as well as the images, audio or video files, logos, trademarks, color combinations, structures, designs, and other elements that distinguish it. These will therefore be protected by current intellectual and industrial property legislation, as well as applicable international treaties. Consequently, the reproduction, distribution, or dissemination of the contents of the PORTAL for commercial purposes, in any medium and by any means, is expressly prohibited without the OWNER's authorization.
The USER agrees to respect the OWNER's intellectual and industrial property rights. However, in addition to being able to view the elements of the PORTAL, the USER may print, copy, or store them, provided that it is exclusively for their strictly personal use.
On the other hand, the USER agrees not to remove, alter, or manipulate any element, file, or content of the PORTAL and, under no circumstances, shall perform acts intended to breach the security of protected files or databases, whether through restricted access via a user and password, or because they do not have the necessary permissions to view, edit, or manipulate them.
In the event that the USER or any third party believes that any of the content of the PORTAL violates intellectual or industrial property rights, they must immediately inform the OWNER using the contact details available on the PORTAL.
IX. APPLICABLE LEGISLATION AND JURISDICTION
The OWNER reserves the right to take any civil or criminal actions it deems necessary for the improper use of the PORTAL, its contents, products, or services, or for non-compliance with these TERMS AND CONDITIONS.
The USER expressly waives the jurisdiction of their present or future domiciles and submits to the Judges and Courts of **Madrid, Spain**, for the interpretation, compliance, and enforcement of these TERMS AND CONDITIONS.
